Tracking Environmental Liens

Environmental Protection Agency (EPA) is tasked with overseeing compliance and enforcement of environmental laws. If EPA determines that real property and land have been contaminated by hazardous material, it can place a lien on the property and obligate the owner to clean up. The liens are filed with the Clerk of United States District Court in the district where the contaminated property is located.

Title insurance companies take exception to Environmental Liens in the title policy. It is important that underwriters have up to date and detailed information on sites that EPA has declared contaminated and the parcels on, and in the vicinity of, the site that could potentially be impacted.

The example below illustrates the site of The Iron Horse Park Superfund. The 553-acre industrial complex is located in North Billerica, Massachusetts. A long history of industrial activities at the site, beginning in 1913, has resulted in the contamination of soil, sediments, groundwater, and surface water. Site cleanup, operation and maintenance activities, and environmental monitoring are ongoing.
